Terms and Conditions

1. RespondCapture Services

RespondCapture provides recruiting technology and related services for public-safety organizations. The Services may include:

• Recruitment websites and application forms
• Applicant and candidate tracking
• Candidate communications
• Interview, deadline, and task reminders
• Automated recruitment and nurture communications
• Reporting and recruitment analytics
• Tools used by participating public-safety agencies and their authorized personnel

Some Services may be governed by a separate agreement between RespondCapture and a participating agency. If a separate written agreement conflicts with these Terms, that agreement controls for the applicable agency.

2. RespondCapture Is Not the Employer

RespondCapture provides technology and communication services to participating recruiting agencies. RespondCapture is not the employer, hiring authority, background investigator, or decision-maker for positions offered by those agencies.

Each participating agency is independently responsible for:

• Its job postings and application requirements
• Its recruiting and hiring decisions
• Communications sent on its behalf
• Compliance with employment and public-sector hiring laws
• The accuracy of information it provides through the Services

Submitting an application or communicating through RespondCapture does not guarantee an interview, advancement, offer of employment, or employment.

Questions about a particular position, application, or hiring decision should be directed to the participating agency.

3. Eligibility and Accounts

You must provide accurate and current information when using the Services. If you create an account, you are responsible for protecting your credentials and for activity conducted through your account.

You may not:

• Use another person’s account without authorization
• Misrepresent your identity, qualifications, or affiliation
• Attempt to gain unauthorized access to the Services or another user’s information
• Interfere with the security, availability, or operation of the Services
• Use the Services for unlawful, fraudulent, abusive, or discriminatory purposes
• Upload malicious software or content that infringes another party’s rights

You must notify RespondCapture promptly if you believe your account or information has been accessed without authorization.

4. Applications and Information You Submit

You retain ownership of information and materials you submit through the Services. You authorize RespondCapture to process, store, transmit, and display that information as necessary to provide the Services to you and the participating agency.

Information submitted through a recruitment or application form may be shared with the agency associated with that position or recruiting campaign.

Do not submit information that is false, unlawful, or unrelated to the application or recruiting process. When sensitive information is requested, follow the instructions provided by the participating agency and use only the designated form or secure upload method.

Our collection and use of personal information are also governed by the RespondCapture Privacy Policy.

5. SMS and Text Messaging Terms

Program Description

The RespondCapture Recruiting Messages program provides text messages from RespondCapture and participating recruiting agencies to people who have expressly opted in.

Messages may include:

• Application confirmations and status updates
• Interview, testing, appointment, and deadline reminders
• Document and task requests
• Recruiter follow-ups
• Responses to candidate questions
• Automated messages related to an active recruiting process
• Relevant information about recruiting opportunities

Consent

You may opt in by entering your mobile telephone number on a RespondCapture-powered web form and selecting an optional, unchecked checkbox agreeing to receive text messages.

Consent to receive text messages is optional. It is not a condition of applying for employment, receiving consideration for a position, or purchasing any product or service.

Message Frequency and Charges

Message frequency varies based on your application activity, recruiting interactions, and the communications configured by the participating agency.

Message and data rates may apply. Your wireless carrier’s standard messaging and data charges may apply to messages sent or received under this program.

Opting Out

You may reply STOP to any message to stop receiving text messages through that messaging program. After your request is processed, no additional messages will be sent unless you provide new consent.

You may reply HELP for assistance or contact RespondCapture at contact@respondcapture.com.

Supported opt-out requests may also include CANCEL, END, QUIT, STOPALL, REVOKE, OPTOUT, or UNSUBSCRIBE.

Delivery

Wireless carriers are not responsible for delayed or undelivered messages. Message delivery may be affected by carrier availability, device compatibility, network conditions, or an incorrect or reassigned telephone number.

You are responsible for notifying RespondCapture or the participating agency if your mobile number changes or is reassigned.

Privacy

Mobile numbers, SMS opt-in records, and SMS consent information are handled according to the RespondCapture Privacy Policy.

RespondCapture does not sell, rent, or share mobile phone numbers or SMS consent information with third parties or affiliates for their marketing or promotional purposes.

6. Email and Other Communications

When you provide an email address or other contact information, RespondCapture or the participating agency may use it to respond to your request and provide application, account, recruiting, or service-related communications.

Where required, marketing communications will include a method for unsubscribing. Opting out of marketing messages may not prevent transactional communications necessary to administer an account or active application.

7. Intellectual Property

The Services, including their software, designs, text, graphics, trademarks, logos, documentation, and other content, are owned by RespondCapture or its licensors and are protected by applicable intellectual-property laws.

RespondCapture grants you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. No ownership rights are transferred to you.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except where expressly permitted by law or a written agreement with RespondCapture.

8. Third-Party Services and Links

The Services may link to or integrate with third-party websites and services, including participating agency websites, job boards, communications providers, analytics providers, file-storage providers, and identity or authentication services.

RespondCapture is not responsible for third-party content, availability, security, or privacy practices. Your use of a third-party service may be governed by that provider’s terms and policies.

9. Service Availability and Changes

We may modify, suspend, or discontinue portions of the Services as our offerings evolve. We may also perform maintenance or make changes necessary for security, compliance, or reliability.

We do not guarantee uninterrupted or error-free availability. We will use commercially reasonable efforts to operate the Services reliably and protect the information entrusted to us.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” RespondCapture disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

RespondCapture does not guarantee employment outcomes, candidate qualifications, hiring decisions, message delivery, or the accuracy of information provided by participating agencies or other users.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, RespondCapture and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, loss of data, or interruption of service arising from use of the Services.

RespondCapture’s aggregate liability arising from these Terms or the Services will not exceed the greater of:

1. The amount you paid directly to RespondCapture for the Services during the twelve months preceding the event giving rise to the claim; or
2. One hundred U.S. dollars.

These limitations do not apply where prohibited by law.

12. Suspension and Termination

RespondCapture may restrict, suspend, or terminate access to the Services when reasonably necessary to:

• Protect the Services or their users
• Address suspected fraud, abuse, or unlawful activity
• Enforce these Terms
• Comply with legal requirements
• Honor instructions from a participating agency concerning its authorized users

You may stop using the Services at any time. Requests concerning deletion or access to personal information are handled according to the Privacy Policy and applicable law.

13. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

Unless a separate written agreement provides otherwise, legal proceedings relating to these Terms or the Services must be brought in the state or federal courts located in Deschutes County, Oregon, and the parties consent to those courts’ jurisdiction.

14. Changes to These Terms

We may update these Terms to reflect changes to the Services, our practices, or applicable requirements. The updated Terms will be posted on this page with a revised effective date.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those updates where permitted by law.
